This Criminal Original Petition has been filed to direct the 2nd respondent police to provide police protection to the petitioners on the basis of his complaint dated 14.03.2019.
2. It is seen from the records that there is a dispute between the landlord and the tenant. The petitioner has already filed a suit in O.S.No.1117 of 2013 before the District Munsif Court, Coimbatore. In the said suit, the petitioner has filed I.A.No.834 & 835 of 2013, seeking for interim injunction restraining the defendant from interfering the peaceful possession and enjoyment of the suit property. The Court below has also granted an order of injunction in favour of the petitioner, as against which the landlord filed an appeal in CMA No.25 and 26 of 2013 before the I-Additional SubCourt, Coimbatore and the same was also dismissed. landlord is now trying to evict the petitioner from the dispute property. Therefore, the petitioner filed the complaint before the 2nd respondent and the same has been registered in Crime No.1356 of 2017 as against the landlord. Infact, the landlord was remanded under judicial custody and released on bail and again trying to evict the petitioner from the property, illegally. In this regard, the petitioner lodged the complaint before the 2nd respondent dated 14.03.2019.
4. Heard both sides.
5. Considering the facts and circumstances of the case, the 2nd respondent is directed to conduct an enquiry on petitioner's complaint dated 14.03.2019 along with the counter party after giving due opportunities and pass orders on merits in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.
6. The criminal original petition is disposed of with the above direction.
