a) to direct the defendant to pay a sum of Rs.21,01,588/- (Rupees twenty one lakhs one thousand five hundred and eighty
eight only) towards refund of the advance amount paid together with interest at the rate of 18% p.a. from the date of plaint till the date of realisation, (b)to direct the defendant to pay Rs.5,00,000/-(Rupees five lakhs only) towards additional hire payment made for engaging Tug M.T. Maju-2 at the rate of Rs.50,000/- per day for ten days together with interest at the rate of 18% p.a. from the date of plaint till the date of realization, and c) costs of the suit;

Despite several opportunities, the plaintiff has not evinced interest to adduce evidence in support of its case. Accordingly, the matter came up before the Court for further proceedings. 2.Today, when the matter is listed under the caption ''for dismissal'', the counsel who represents the plaintiff states that
the Court may pass appropriate orders as there is no instructions from the party.
