Mr.S.Vinoth Kumar Government Advocate (Crl.Side) Order The petitioners, who were arrested and remanded to judicial custody on 26.02.2026 for the alleged offences under Sections 7, 20(1) of COTPA Act 2003 and sections 275, 123 and 62 of BNS (273, 328 and 511 of IPC) in Crime
No.50 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioners were found transporting banned tobacco products namely 351 kg of Hans and 9 kg of Vimal Pan Masala. Hence, the case.
3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in the present case and that they have not committed any offence as alleged by the prosecution. He would further submit that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioners.
4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the investigation is at preliminary stage and hence, he opposed the grant of bail to the Petitioner.
5. I have given my anxious consideration to either side submissions and perused the materials available on record.
6. From the submissions made by the learned counsel on either side, it is
seen that the investigation is at preliminary stage and there is a huge recovery of banned tobacco products. Considering the stage of investigation and considering the recovery of huge quantity of tobacco product, this Court is of a firm view that it is not appropriate to consider the bail application at this stage.
