The Criminal Original Petition has been filed to quash the First Information Report in Crime No.1937 of 2020 on the file of the first respondent police registered against the petitioner and others for the alleged offence under Sections 147, 148, 341, 294(b), 324 and 506 (ii) of IPC.
2. The main ground on which the FIR sought to be quashed is that there is no specific overtact against the accused. It is relevant to note that such a contention has no force. Admittedly, the offence under Sections 147 and 148 of IPC have also been invoked, it has to be seen by the trial Court, whether https://hcservices.ecourts.gov.in/hcservices/
the accused act fall under Section 34 or 149 IPC.
3. In such view of the matter, this Court is not inclined to quash the First Information Report filed in Crime No.1937 of 2020 on the file of the first respondent police. Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petition is closed.
