ORDER

Petition seeking bail in respect of Crime No.27 of 2025 registered for the alleged offences punishable under Sections 5(l), 5(j)(ii), 5(k) r/w.6(1) of the Protection of Children from Sexual Offences Act, 2012 in Crime No.27 of 2025, is on board for consideration.

2. The case of the prosecution is that the petitioner committed penetrative sexual assault on the victim girl aged about 15 years who is already 40% mentally retarded and this assault was taken place on some time, and which resulted in causing pregnancy and during school hours she suffered illness. Later, she was taken to the hospital, where, it was revealed that the victim has suffered penetrative sexual assault by the petitioner herein. Hence, the case.

3. Learned counsel appearing for the petitioner submitted earlier this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.4577 of 2026. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. He also submitted that the petitioner is in incarceration from 29.12.2025. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that the petitioner committed very serious and heinous offence on the victim girl and the investigation is still pending.

5. Heard both sides and perused the materials available on record.

Considering the nature and gravity of the offence and the fact that the victim girl was aged about fifteen years at the time of occurrence and also the petitioner committed very serious and heinous offence against the mentally retarded victim girl, this Court is not inclined to grant bail to the petitioner. 7.
