This Criminal Original Petition is filed to call for the records pertaining to the case in C.C.No.570 of 2010 on the file of the Judicial Magistrate Court No.II, Erode and quash the same.

2.The learned counsel for the petitioner advanced his arguments and further he states that one Nandakumar had only borrowed a sum of Rs.2,00,000/- (Rupees Two lakhs only) and obtained blank cheque from the petitioner. Using the same, he had filled up the same for a sum of Rs.10,00,000/- (Rupees Ten lakhs only) being the liability amount and had initiated the proceedings under Section 138 of the Negotiable Instruments Act.

3.Now, the learned counsel for the petitioner seeks the permission of this Court to withdraw the Criminal Original Petition.

4.It is represented by the learned counsel for the respondent that the case has been now transferred to the file of the Fast Track Court No.II, Erode as S.T.C.No.154 of 2018. 5.The learned counsel for the petitioner is permitted to withdraw the Criminal Original Petition, since the case is pending from the year 2010. The trial Court is directed to complete the trial and conclude the case, within a period of three months from the date of receipt of a copy of this order.
