This petition is filed to condone the delay of 1323 days in filing the appeal.

2. Heard the learned counsel for the petitioner. We have also heard the learned counsel for the insurance company.

3. In view of the reasons found mentioned in the affidavit filed in support of the Miscellaneous Petition, the delay is condoned. The Miscellaneous Petition is allowed.

4. In case the appeal is ultimately allowed, the petitioner would not be entitled for interest for the period of 1323 days.
