2. Mr.G.Mohammed Aseef, learned counsel, takes notice on behalf of respondents 1 to 3.
3. Notice to fourth respondent is dispensed with since the fourth respondent remained ex parte before the Tribunal.
4. Heard learned counsel on either side.
5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 39 days in filing the above appeal is condoned.
Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course. Registry is directed to print the name of Mr.G.Mohammed Aseef, learned counsel for respondents 1 to 3 at the time of admission.
