O R D E R

This petition has been filed to direct the respondent police to file final report in Crime No.528 of 2012.

2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor for the respondent and perused the materials placed on record.

3. Today, Mr.G.Venkatesan, Inspector of Police, R-4, Soundara Pandianar Angadi Police Station, T.Nagar, Chennai is present and he has filed a Status Report, wherein, in paragraph No.7, it is stated as follows:

"7. I submit that, so far the investigation reveals that, [i] the de facto complainant lodged a complaint against the accused after lapse of 7 years i.e., in the year 2012 whereas he has given money in the year 2005 for the property, which is located at Mangadu CTA-Phase II - No.8.

[ii] Further with regard to the same allegation, a complaint was lodged by one of the victim Tmt.A.Nagalakshmi @ Kumari against the said accused Ramachandra Kurup to CCB, Chennai Rural and the same was registered in CCB Crime No.152/2011 under section 420, 406, 468 IPC r/w 471 and the case is still under investigation.

[iii] Further I found that the said accused as if he is a secretary cum President in South India Cine Technicians Association, cheated more than 150 victims [Members of the said Association] by way of collecting money from them, alleged that he will allot the plot to them in Mangadu CTA-Phase II and thereafter construct a building and after registration and handed over to them."

In view of the fact that a case in CCB Crime No.152 of 2011 is pending against the same accused, it will be in the fitness of things, if this case shall also be transferred to Central Crime Branch. Accordingly, this Court transfers Crime No.528 of 2012 from the file of the Inspector of Police, R-4, Soundara Pandianar Angadi Police Station, T.Nagar, Chennai-17 to the file of the Central Crime Branch, Chennai to be investigated along with CCB Crime No.152 of 2011.

5. The Inspector of Police, Soundara Pandianar Angadi Police Station is directed to immediately forward the Case Diary in Crime No.528 of 2012 through the Deputy Commissioner of Police to the Central Crime Branch to be investigated along with CCB Crime No.152 of 2011.
