ORDER
Heard the learned counsel for the petitioner (5th claimant) and the learned counsel for the respondents (claimants no.1 to 4).
2. 5th claimant in LAOP.No.229 of 2024 on the file of the Principal District Court, Kancheepuram is the petitioner herein.
3. The petitioner would aver that she is aged about 62 years and due to removal of gallbladder and uterus, she could not travel much less than two hours continuously. She would further aver that she finds it extremely difficult to travel to Kancheepuram for each and every hearing. On the ground of convenience, she has filed Tr.C.M.P.
4. The learned counsel for the petitioner would reiterate the grounds set out in the Tr.CMP and seeks to transfer the aforestated LAOP pending on the file of the Principal District Court, Kancheepuram to the learned Principal Judge, City Civil Court, Chennai.
5. Per contra, the learned counsel for the respondents (claimants no.1 to 4) would vehemently contend that the petitioner has instituted a suit in O.S.No.109 of 2026 for declaration of title in respect of the property connected with the said LAOP and it is pending before the Principal District Court, Kancheepuram.

From the E-Court details, it is deducible that on 27.03.2026, the proof affidavit of C.W1 was recorded and Ex.C1 to Ex.C4 were marked and for cross examination of C.W1 by clamant no.5, the matter was posted to 18.04.2026. Thereafter, it has been adjourned to 03.06.2026. When the case is at part-heard stage, within a few hearing the proceedings would come to an
end for examining the witnesses. For examining herself, she has to attend the Court proceedings. The 5th respondent Referring Officer, Managing Director, SIPCOT is situate at Kancheepuram - Irungattukottai. She has also filed yet another suit which is pending before the same Court.
7. The petitioner would aver that on the ground of convenience, she has taken out this Tr.CMP. The matter is being in part-heard stage and for the reasons mentioned supra, this Court is of the considered view that the grounds set out by the petitioner cannot be taken as sufficient cause. Accordingly, this Transfer Civil Miscellaneous Petition stands dismissed. The learned Judge of the Principal District Court, Kancheepuram shall take effective steps to dispose of the LAOP at the earliest. There is no order as to costs.
