T.R.Sivaram ..Respondents Prayer:- The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the third respondent herein not to proceed with the appeal pending before him in Na.Ka.No.8/2016 filed by the 5th respondent until such time the civil court proceedings are finally disposed off by the Civil Court in OS.No.62 of 2015, II Additional District Judge, Tiruppur.

ORDER

This Writ Petition has been filed by the petitioner for issuance of a Writ of Mandamus, directing the third respondent herein not to proceed with the appeal pending before him in Na.Ka.No.8/2016 filed by the 5th respondent.

2. The learned counsel for the fifth respondent by producing the order of the Revenue Divisional Officer, dated 09.08.2016, passed in Na.Ka.No.8 of 2016/A2 would state that the third respondent had already passed order and hence the prayer sought for in this Writ Petition has become infrucutous. The said order is taken on file.

3. In the light of the above fact, this writ petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
