Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus to direct the respondents to consider the petitioner's representation dated 16.12.2014 and give promotion to the petitioner as Headmaster in the Elementary School in Kangeyam Panchayat Union along with monetary benefits. ORDER
The grievance of the petitioner is that she may be permitted to participate in the counseling for promotion to the post of Headmaster in the Elementary School that would take place in May, 2015. She made a representation dated 16.12.2014 in this regard to give him promotion.
2. Now, a counter affidavit has been filed by the 3rd respondent, wherein it is stated at paragraph No.4 as under: ''4. .... And it is further submitted that the averment made by the petitioner in 6th para by taking the issue of representation sent by her on 16.12.2014 has been reached to the office of the 3rd respondent only on 30.12.2014
which was taken under consideration by the 2nd respondent and passed an order with proceeding of Na.Ka.1747/A4/2013 dated 28.1.2015 initiating with ref of G.O.3(D).no.4 School Education (Nee.Va3(1) department dated 21.01.2015 alogn with proceeding of Director of Elementary Education processing letter Na.Ka.No.30415/E3/2014 dated 23.01.2013 to the 3rd respondent on 29/1/2015, that to follow the Circular of the 1st respondent and consider the petitioner representation for the promotion of the petitioner as Headmaster in Elementary School in Kangeyam Panchayat Union by processing and verifying all the details of the promotion needs and seniority basing on experience Certificate of the petitioner during the time of petitioner worked at Panchayat Union Elementary School, Paramathi Union, Karur District have to be undertaken before the putting up the final list of seniority panel list as on 1.1.2015 same has to be reported to the 2nd respondent.''

In view of the aforesaid statements made by the 3rd respondent in paragraph No.4 of the counter, the writ petition is disposed of by directing the respondents to permit the petitioner to participate in the counseling for the post of Elementary School Headmaster that would take place during May, 2015. No costs. Consequently, the connected miscellaneous petition is closed.
