Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India, praying for the issuance of Writ of Mandamus, directing the 1st and 2nd respondents to grant police protection to the petitioner enjoying subject property in resurvey (R.S) No. 153/20, 496 Part, Patta No. 195, Door No. 3, 5, 6th Cross Street, Bharathi Nagarm Karuvadikuppam, Lawspet, Puducherry by considering the letter dated 20.03.2023 till pending disposal of the O.S.No. 2464 of 2021 on the file of AMC, Puducherry in the interest of justice.

O R D E R

This Writ Petition has been filed seeking a direction to the 1st and 2nd respondents to provide police protection to the petitioner for the purpose of enjoying the subject property comprised in resurvey (R.S) No. 153/20, 496 Part, Patta No. 195, situated at Door No. 3, 5, 6th Cross Street, Bharathi Nagarm Karuvadikuppam, Lawspet, Puducherry.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. Admittedly, a civil suit in O.S.No.2464 of 2021 is pending on the file of the Additional District Munsif, Puducherry as against the third respondent. Therefore, it is open to the petitioner to approach the Civil Court and seek appropriate relief in accordance with law.

4. In view of the above, this Court is not inclined to grant the relief sought for in this petition. Accordingly, this Writ Petition stands dismissed. No costs.
