This Civil Suit filed under IV Rule 1 of Original Side Rules R/w order VII Rule 1 of the Code of the Civil Procedure, prays to pass a judgment and decree in favour of the plaintiff and as against the defendants: Partition and Separate Possession of the plaintiffs' half share in the suit property.

JUDGMENT

The suit has been filed for Partition and separate possession of the plaintiffs' half share in the suit property.

2.Earlier, the suit was referred to Mediation and Conciliation Centre, and in the Mediation the parties have settled the dispute between themselves. Now, they have filed a joint memo of compromise dated 15.04.2018 before this Court, signed by the plaintiff and the defendant and counter-signed by their respective counsels. By the above settlement, both the plaintiffs have given the entire suit properties in favour of the defendant.

2.The terms of memorandum of compromise is hereby recorded and the terms thereof are extracted below:

"In view of the compromise arrived in O.S.A.

No.227 of 2013 and fulfillment of the terms thereof, the suit property bearing Door No.5, Kasturi Ranga Road, Alwarpet, Chennai -18, of an extent of 3 grounds and 884 sq.ft bering Plot No.1, comprised in R.S. No.1576/7 (Old R.S. No.1576/1 part, O.S. No.2757, c.c. No.3963, Block No.32 of Mylapore Division, Mylapore Triplicane Taluk. Chennai District known as 'Gayatri' situate within the Sub-Registration District of Mylapore and Registration District of Chennai Central, hereby stands alloted absolutely to the Defendant.

ii) The prayer for mesne profit is given up by the plaintiffs.

iii) A final decree may be passed in terms of this Joint Memo of Compromise, the costs, if any, of which shall be borne by the Defendant"

3. In view of the above, the suit is decreed in terms of memo of compromise dated 15.04.2018, and a final decree is also passed as per the joint compromise memo. The compromise memo shall form part and parcel of this order.
