ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.09.2025 for the alleged offence under Section 5(l), 5(j)(ii) r/w 6 of POCSO Act 2012 in Crime No.46 of 2025 on the file of the respondent police, seeks

bail.

2. The case of the prosecution is that the petitioner had sexual relationship with a false promise of marriage, due to which the victim girl had become pregnant. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner has been incarcerated since 26.09.2025 and charge sheet has been filed and taken on file as Spl.SC.No.265 of 2026 before the Court of Sessions, Mahila Court, Tiruppur. He further submitted that the petitioner was in love affair with the victim girl. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.

Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and produced the statement recorded from the victim girl by the learned Judicial Magistrate, Tiruppur dated 15.10.2025 against the petitioner. Hence, he opposed the grant of bail to the Petitioner.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. From the submissions made by the learned counsel on either side and considering the statement recorded under section 183 of BNSS, though the victim had stated about the relationship with this petitioner, considering the age of the victim and the petitioner and upon the fact that the petitioner being a married man, this Court is not inclined to enlarge the petitioner on bail as it may have adverse impact on the prosecution case and jeopardise the trial proceedings . Hence, this Criminal Original Petition is dismissed. 25-03-2026 SHL To:
