O R D E R
This Civil Revision Petition has been filed to direct the I Additional Family Court, Chennai to dispose of the petition in O.P.No.1105 of 2014 within the stipulated time.
2.Learned counsel for the petitioner/husband, who is the petitioner in O.P.No.4450 of 2011 submitted that the respondent/wife filed the petition in
O.P.No.1105 of 2014 for divorce on the ground of cruelty and desertion which is pending for more than a year. He further submitted that this Court has already given a direction in C.R.P.No.3111 of 2015 on 31.07.2015 to dispose of O.P.No.4450 of 2011 within a period of four months from the date of receipt of copy of that order. Thereafter, the petitioner filed a memo for joint trial and also for early disposal. Hence, he pray for an order. 3.Heard the learned counsel for the petitioner and perused the typed set of papers. Considering the limited nature of the relief as sought for herein, notice to the respondent is dispensed with.
4.The petitioner herein as a petitioner filed O.P.No.4450 of 2011 for restitution of conjugal rights and this Court by order dated 31.07.2015 in C.R.P.No.3111 of 2015 has directed the Trial Court to dispose of O.P.No.4450 of 2011 within four months from the date of receipt of a copy of that order. Thereafter, the respondent/wife filed O.P.No.1105 of 2014 for divorce on the ground of cruelty and desertion which is pending on the file of the I Additional Family Court, Chennai. Therefore, in order to avoid multiplicity of proceedings and conflicting of judgments, both the cases are to be tried jointly. Hence, joint trial is hereby ordered. So, it is a fit case to direct for early disposal. Accordingly, the I Additional Family Court, Chennai is directed
to dispose of both O.P.Nos.4450/2011 and 1105/2014 within three months from the date of receipt of a copy of this order.
5.With the above direction, this Civil Revision Petition is disposed of. No costs.
