This Civil Miscellaneous Petition has been filed seeking to permit the petitioner to file the appeal as an indigent person.
2. Today, when the matter taken up for hearing, there is no representation on the side of petitioners. Mr.L.Ramu, learned counsel for respondent would submit that the 1st petitioner is a retired police officer and he is having sufficient source of income and also property, for which, the court below also made an observation to that effect. Hence, he prayed to dismiss this petition.
3. Considering submissions of respondent's counsel, it reveals that the 1st petitioner is a retired police officer and he is having sufficient source of income as well as property. Hence, the petitioners are not permitted to file the Second Appeal as indigent persons and they are directed to pay the court fee as prescribed under law within a period of four weeks from the date of receipt of copy of this order. Accordingly, this Civil Miscellaneous Petition is dismissed.
