ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.01.2026 for the alleged offences under Sections 309(4) of the Bharatiya Nyaya Sanhita, 2023, (Section 392 of Indian Penal Code, 1860) in Crime No.267 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 30.12.2025, the defacto complainant was standing outside her house, when the petitioner along with

another person approached her requesting drinking water. When she went inside to fetch water, the petitioner at knife point snatched a gold chain from her. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged and has been falsely implicated in this case. The learned counsel would further submit that the petitioner has been in incarceration since 02.01.2026. It is also submitted that the investigation has been completed and charge sheet has been filed. The learned counsel would further contend that the petitioner will not abscond or tamper with witnesses and is ready to cooperate with the trial. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the present case involves snatching of gold from a woman at knife point. It is further submitted that the petitioner has got nine previous cases relating to theft and robbery, which clearly shows his criminal antecedents. It is also submitted that if the petitioner is enlarged on bail, there is every possibility that he may again indulge in similar offences. Hence, he strongly opposed the grant of bail.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

This Court is of the view that from the submission of the learned counsel on either side, it is seen that the allegation against the petitioner is one of snatching of gold from a woman at knife point. Though the petitioner has been in incarceration since 02.01.2026, it is seen that he has criminal antecedents relating to theft and robbery. Considering the past conduct of the petitioner, this Court is of the view that if the petitioner is enlarged on bail, there is every likelihood of him committing similar offences again. Hence, this Court is not inclined to grant bail to the petitioner.
