Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to disburse my provisional pension from 01.07.2017 onwards based on the recommendation made by the 3rd respondent in proceedings Na.Ka.No.4313/2016/A.3 dated 12.10.2017 within the time stipulated by this Hon'ble Court. ORDER

It appears that the petitioner in this case has come to this Court to challenge the non-sanction and non-release of provisonal pension though the petitioner has been allowed to retire from service, pending disposal of a criminal complaint. But the learned counsel appearing for the respondents today submitted the proceedings in RC.No.3498/2015-A-2 dated 01.08.2018 before this Court indicating the fact that the arrears of provisional pension has already been sanctioned and in view of the same nothing remains to be adjudicated in this case and as such, the writ petition deserves to be closed, submits the learned counsel appearing for respondents. 2.

petitioner submits that the same is yet to be released and hence the 3rd respondent who is the drawal authority, be directed to release the same within a stipulated period.

Considering the aforesaid facts and submissions made, especially the fact that the provisional pension has been sanctioned vide the aforesaid order, this writ petition is disposed of with a direction to the 3rd respondent to draw the same, within a period of two weeks from the date of receipt of copy of this order, if not already drawn and disburse the same to the petitioner. No costs.
