issue a Writ of Mandamus directing the Respondents 1 and 2 herein to return the Security Deposit amount under STDR Account No. 30019371711 along with its maturity value deposited in the name of the General Manager (TN), Food Corporation of India, Regional Office Chennai - FCI A/c. of Shri V.Purushothaman along with its interest till date of its receipt which is deposited in State Bank of India, Tiruppapuliyur Branch, Cuddalore to the writ petitioner herein within the time stipulated by this Hon'ble Court and order for compensation payable by the 1st and 2nd respondents for not refunding the security deposit and retaining the amount without assigning any reasons till date.

This writ petition has been filed seeking issuance of Writ of Mandamus directing the respondents 1 and 2 to return the Security Deposit amount under STDR Account No. 30019371711 along with its maturity value deposited in the name of the General Manager (TN), Food Corporation of India, Regional Office Chennai - FCI A/c. of Shri V.Purushothaman along with its interest till date of its receipt which is deposited in State Bank of India, Tiruppapuliyur Branch, Cuddalore 2/6

to the petitioner within the time stipulated by this Court and order for compensation payable by the respondents 1 and 2 for not refunding the security deposit and retaining the amount without assigning any reasons till date.

2.The learned counsel appearing for the petitioner submitted that the petitioner had effected 50% of the security deposit amount of Rs.2,50,000/- for handling and transport (H & T) contract in Food Corporation of India for the period commencing from 26.04.1999 to 25.04.2001 by way of fixed deposit drawn from State Bank of India in favour of the General Manager (TN), FCI, Chennai and 5% from each bill was deducted by Food Corporation of India to adjust the remaining 50% of the security deposit amount. The petitioner adhered to the norms and conditions of the contract and completed the tenure and was entitled for refund of the entire security deposit of Rs.2,50,000/-, however, Food Corporation of India failed and neglected to refund the security amount. Hence, the petitioner made representation dated 09.09.2021 to the respondents 1 and 2 seeking refund of the security deposit, however, there is no response. Hence, this Court may without going into the merits of the case, issue direction to the 3/6

respondents 1 and 2 to consider the petitioner's representation and to pass appropriate orders within a reasonable time frame. 3.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondents 1 and 2 to consider the petitioner's representation dated 09.09.2021, on merits and in accordance with law and to pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order. 4.The writ petition is disposed of.
