The reasons stated for condoning the delay is that the petitioner filed an Interlocutory Application to amend the mistakes in the decree and therefore, there is a delay of 409 days in filing the appeal suit against the judgment and decree passed in the original suit.

2. Considering the reasons stated in the accompanying affidavit filed in support of the miscellaneous petition, this Court is inclined to condone the delay.

Accordingly, the delay of 409 days in filing the appeal suit stands condoned and the petition is ordered.
