This Criminal Original Petition is filed to quash the Crime No.13 of 2022 on the file of All Women Police Station, Madipakkam. 2.

The respondent police has registered a case against the petitioner herein for offence under Section 376, 377, 354A(1)(i), 354A(1)(ii), 354D, 506(i) IPC and Section 66E & 67 of Information Technology Act, 2000, based on the complaint given by one Vidya, alleging that it was a love affair and consensual sex. The father of the defacto complainant who was not willing for the marriage has invented story leading to the complaint to break the love affair. 3.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that Section 164 Cr.P.C., statement and the medical records indicates that a cognizable offence to proceed against the petitioner is made out including telephone and SMS. 4.

It is a matter for investigation and the respondent police is bound to investigate the matter free and fair manner. Just because the petitioner claims that it is a love affair and consensual incident cannot 2/4

take it as plausible truth and quash the complaint. Hence this Criminal Original Petition is dismissed. Consequently, the connected Criminal Miscellaneous Petition is also dismissed.
