O R D E R

(This case has been heard through video conference) The petitioner/A2 who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(aaa), 4(1-A) of Tamil Nadu Prohibition Act r/w Sections 5, 6 & 13 of Tamil Nadu Rectified Spirit Rules 2000, in Crime No.291 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in possession of Rectified Spirit. Hence, the complaint was registered.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Therefore, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner was found in possession of 525 litres of Rectified spirit. He would further submit that there are three previous cases pending as against the petitioner. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the above facts and circumstances of the case and that there are three previous cases pending as against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
