The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 420 read with 34 of IPC, in Crime No.6 of 2022, seek anticipatory bail.

2. The case of the prosecution is that the petitioners induced the defacto complainant and 10 other victims, under the false promise of securing job in BSNL received amounts to the tune of Rs.1,29,45,048/- and cheated them. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. He would further submit that due to misunderstanding between the defacto complainant and the main accused namely Santhosh Kumar, the petitioners have been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent vehemently opposed for grant of anticipatory bail to the petitioners stating that it is a case of job racketing. Apart from the defacto complainant, the accused persons have cheated 10 other gullible victims and the cheated amount is more than Rs.1 Crore and that the investigation is pending.

5. Heard both sides and perused the materials available on record.

6. Taking into consideration the nature of offence and that the amount involved in this case is more than Rs.1 Crore, this Court is not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, these Criminal Original Petitions stand dismissed.
