Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 2nd and 3rd respondents to consider the petitioner's candidature under the OBC category on the basis of the certificate issued by the Tahsildar, Salem.

O R D E R

The petitioner seeks for a mandamus directing the respondents 2 & 3 to consider his candidature under the OBC category on the basis of the certificate issued by the Tahsildar, Salem.

2. Heard the learned counsel appearing for the petitioner, the learned standing counsel appearing for the second respondent and the learned Special Government Pleader appearing for the third respondent.

3. The case of the petitioner is that at the time of applying for NEET Examination, his category was wrongly shown as UR instead of OBC, even though the petitioner belongs to OBC category. Therefore, now the petitioner seeks to change his category from UR to OBC and consider him for admission to MBBS/BDS course under such OBC category.

4. Admittedly, the petitioner has approached this Court and filed the present writ petition only after publication of the merit list and commencement of the counselling. Apart from the above said fact, it is to be noted that the counselling is already over and the last date for admission is also over. Therefore, at this stage, the petitioner cannot seek any indulgence from this Court, by way of filing the present writ petition. Therefore, this Court, is not inclined to entertain this writ petition. Accordingly, the writ petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
