J U D G M E N T

The matter stands listed today for reporting settlement. A Memo of Compromise dated 15.08.2015 signed by the appellant and the respondents 1 and 2 and also by their respective counsel has been filed. The appellant and respondents 1 and 2 are also present in person along with their respective counsel. On being questioned, they confirm that they entered into a compromise voluntarily and they request that the second appeal be disposed of in terms of the Compromise Memo.

2. Accordingly, the Compromise Memo is recorded. The second appeal is allowed and the decree of the lower appellate court is set aside. The original suit is decreed in terms of the Memo of Compromise. The Memo of Compromise shall be annexed to the decree https://hcservices.ecourts.gov.in/hcservices/

and the same shall form part of the decree. However, there shall be no order as to cost.
