Thiru Veerabahu v. Tmt. D. Gomathi,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 23.12.2016 C O R A M THE HONOURABLE Mrs.JUSTICE PUSHPA SATHYANARAYANA C.R.P.P.D.No.4018 of 2016 Veerabahu .. Petitioner -Vs.- D.Gomathi .. Respondent Civil Revision Petition filed under Article 227 of the Constitution of India praying to direct the Principal Subordinate Judge, Tiruppur to dispose of H.M.O.P.No.54 of 2012 within the time frame fixed by this Court.
For petitioner ... Mr.M.Sriram
O R D E R
H.M.O.P.No.54 of 2012 is filed by the husband under Section 13(1) (1a) of the Hindu Marriage Act on the file of the Subordinate Court, Tiruppur on the ground of cruelty.
2. Though the pleadings are complete and posted for enquiry, it has been adjourned again and again without any reasons thereof. In the meanwhile, the wife has also filed a petition in I.A.1008 of 2015 for interim maintenance for herself and son including legal expenses. It is pointed out by the learned counsel for the petitioner that in the proceedings under the Domestic Violence Act, the husband has already been paying a sum of Rs.7,000/- per month as maintenance. Therefore, there is no necessity for adjourning the interlocutory application, which has been filed in the year 2015 only to stall further proceedings in the H.M.O.P. Hence, the revision petitioner seeks a time frame for disposal of H.M.O.P.
3.
Considering the above and also the fact that the H.M.O.P is pending from the year 2012, the learned Subordinate Judge, Tiruppur is directed to dispose of the H.M.O.P.No.54 of 2012 on merits as expeditiously as possible, preferably on or before 30.04.2017.
4.
With the above direction, the Civil Revision Petition is disposed of. No costs.
