These Civil Miscellaneous Petitions are filed to condone the delay of 2444 days in filing the petition to set aside the abatement caused due to the death of the 1st respondent viz., K.Muthu Gounder; to set aside the abatement caused due to the death of the 1st respondent viz., K.Muthu Gounder; and to bring on record 1.Pavayee, W/o.Late K.Muthu Goundar, 2.Rajendran, S/o. Late K.Muthu Goundar, 3.Chinthamani, D/o. Late K.Muthu Goundar, respondents 3 to 5 herein, legal representatives of deceased Late K.Muthu Goundar, as the respondents 3 to 5 in the above Civil Miscellaneous Appeal. 2.The learned counsel appearing for the petitioner submitted that the petitioner may be permitted to give up the claim as against respondents 3 to 5 and made an endorsement to that effect.

3.Though notice has been served on the respondents 2 & 4 and their names are printed in the cause list, there is no representation on behalf of them either in person or through counsel.

4.Being satisfied with the reasons set out in the affidavit filed in support of the Civil Miscellaneous Petitions, C.M.P.No.8843 of 2019 is ordered and delay is condoned. In view of the order passed in C.M.P.No.8843 of 2019, the C.M.P.Nos.8847 and 8849 of 2019 are also ordered. 5.Registry is directed to carry out the necessary amendment. 05.02.2020 1/2 http://www.judis.nic.in
