O R D E R

The petitioners, who were arrested and remanded to judicial custody on 22.12.2024 for the offences under Sections 8(c)r/w 20(b)(ii)(C) and 8(b) r/w 20(a)(i) of NDPS Act in Crime No.267 of 2024 on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioner along with other accused is alleged to have illegally cultivated ganja plants near Perumanatham Village, which belongs to the Forest Area. It is alleged that 1600 ganja plants were cultivated weighing around 104 kgs of ganja. 3.The learned counsel appearing for the petitioner submitted that the prosecution has weighed the entire plants including stem and root, which cannot be considered as commercial quantity.

4.This Court leaves this question open for the trial Court to decide while considering the bail petition. Taking note of the material on the face of 2/4

the records, there is enough material to hold that the petitioner has violated the provision of the NDPS Act by cultivating cannabis plants unauthorizedly. Hence, this Criminal Original Petition stands dismissed. The trial Court is directed to take up the trial out of turn and decide it as expeditiously as possible within a period of four months.
