O R D E R
(Made by V.RAMASUBRAMANIAN, J) The petitioner whose application for enrolment as advocate was not entertained by the Bar Council of Tamil Nadu and Puducherry, has come up with the above writ petition, seeking a mandamus to direct the Bar Council of Tamil Nadu and Puducherry to enrol him as advocate.
2. We have heard Mr.M.Palanimuthu, learned counsel for the petitioner and Mr.S.Y.Masood, learned counsel appearing for the respondent.
3. The application of the petitioner for enrolment was not entertained, on account of pendency of two criminal complaints against him in Crime No.7/2007 on the file of the Cuddalore Old Town Posice Station and in Crime No.7/2013 on the file of the Cuddalore https://hcservices.ecourts.gov.in/hcservices/
Port Trust Police Station. But the petitioner has been subsequently acquitted in both criminal cases. In C.C.No.169 of 2013, which arose out of Crime No.7/2013, the petitioner was acquitted by a judgment dated 1.3.2014 by the Judicial Magistrate No.II, Cuddalore. Similarly, the petitioner was acquitted in C.C.No.147 of 2007, which related to Crime No.7/2007, by a judgment dated 8.5.2015 on the file of the Judicial Magistrate No.II, Cuddalore. Hence, today there is no impediment for the enrolment of the petitioner as advocate. Therefore, the writ petition is allowed and the respondent is directed to process the application of the petitioner if it is otherwise in order and enrol him as advocate. No costs.
