ORDER

The petitioner apprehends arrest for the alleged offence under Sections 8(c), 20(b)(ii)(B) and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.39 of 2026 on the file of the respondent police seeks

anticipatory bail.

2.The case of the prosecution is that the petitioner was found to be in illegal possession of 1.100 kgs of ganja. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner has no connection with the alleged offence and that he has been implicated in this case solely on the basis of the confession statement of the co-accused. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) strongly opposed the application and submitted that the case involves narcotic substances and that the petitioner was found in possession of 1.100 kgs of ganja. He further submitted that if the petitioner is enlarged on bail, it may embolden him to indulge in similar activities.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. Taking into consideration the seriousness of the allegations against the petitioner, this Court is of the firm view that the petitioner does not deserve the

grant of anticipatory bail. If anticipatory bail is granted, it would jeopardize the prosecution case. Accordingly, this petition is dismissed. 24-03-2026 MPA To 1.The Inspector of Police, Deevattipatti Police Station, Salem.
