Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the 2nd respondent in connection with the impugned order passed by him in Na.Ka.No.T1/03366/2014 dated 29/12/2014 and quash the same and further direct the respondents to select the petitioner in pursuance of the marks secured by him based on the decision of the Honble High Court and Supreme Court in SLP No.21828/2006 etc on civil appeal No.7667/2014 etc and civil appeal no 76747681/2014 in SLP(C)No.10304 and 10305/2009 11005-11008/2011 and SLP(C)No.8127 9377/2012 dt 07/08/2014 based on the marks secured by the petitioners in the process of selection conducted in the year 1997-98 and appoint the petitioner as Sub-Inspector and grant him all consequential service and monetary benefits. O R D E R

The learned Additional Advocate General appearing on behalf of the respondents relying on the counter affidavit made a submission that the petitioner had secured the following marks. (a) Physical Efficiency Test 20.00 marks (b) Written Test 14.9375 marks (c) Viva-Voce -- ____________ Total 34.9375 marks The petitioner belongs to BC Community, the cut off mark for BC Community for viva-voce is 43.06 marks and as the petitioner has not secured the required marks, he was not called for the vivavoce. In view of the fact that the petitioner has not scored the cut off mark required for selection, he was not within the zone of consideration and therefore, the question of considering the relief as such sought for in the writ petition does not arise at all. Accordingly, the writ petition stands dismissed. No Costs.
