This petition has been filed to modify the condition imposed on the petitioner by an order dated 14.03.2023 in Crl.O.P.No.5050 of 2023 to deposit a sum of Rs.3,00,000/- in Crime No.397 of 2022, before the concerned Magistrate.

2. The learned counsel for the petitioner submitted that the petitioner was granted anticipatory bail by this Court in Crl.O.P.No.5050 of 2023 on 14.03.2023 with a condition that the petitioner shall deposit a sum of Rs.3,00,000/- (Rupees Three Lakhs only) to the credit of Crime No.397 of 2022, before the concerned Magistrate. He would submit that on behalf of the petitioner, the petitioner's own sister and his husband Akassrhaj Mahendran had earlier paid the amount of Rs.5,00,000/- by way of cheque and thereby she seeks for modification of the condition. 3.Considering the submission made by the learned counsel appearing for the petitioner, the condition imposed as against the petitioner is modified to the effect that the condition No.2, "that the petitioner shall deposit a sum of Rs.3,00,000/- (Rupees Three Lakhs only) to the credit of Crime No.397 of 2022, before the concerned Magistrate" is deleted. drl Further, the petitioner is directed to surrender and execute the surety as ordered by this Court within a period of two weeks from the date on which the present order copy is made ready, failing which, the order passed by this Court shall stand automatically cancelled. 4.With the above directions, this Criminal Miscellaneous Petition is ordered.
