ORDER

This application has been filed for appointment of an Advocate Commissioner to seize and deliver the vehicle available with the respondents. 2.After notice was issued to the respondents, this Court suggested that the matter can be amicably settled between the parties. Accordingly, on 13.08.2025, this Court recorded an offer made by the applicant to the extent that if a sum of Rs.5,00,000/- is paid by the respondents as an one time settlement, it will be accepted by the applicant. This Court directed the learned counsel for the respondents to take instructions.

3.When the matter was taken up for hearing today, it was brought to the notice of this Court that a sum of Rs.5,00,000/- has been paid by the

respondents to the applicant on 16.09.2025. This fact was also confirmed by the learned counsel for the applicant. In the light of the above development, the settlement between the parties is recorded and it is made clear that the applicant will not make any further claim from the respondents. The learned counsel for the respondents submitted that some blank cheques were issued by the respondents to the applicant towards secutiry. If the blank cheques are available with the applicant, the same shall be handed over to the respondents immediately. The applicant financial institution shall also issue no objection certificate to the respondents within 15 working days. This application is disposed of in the above terms.
