ORDER
The petitioner/plaintiff in OS.No.100/1999 has come forward with the above Civil Revision Petition for the early disposal of the said suit stating that the petitioner/plaintiff has filed the suit for ejectment. The respondent, as a
defendant, filed an application for claiming the benefit under section 9 of the City Tenants Protection Act, which was already disposed of and the suit is yet to be disposed. The proof affidavit is also filed. Hence, the learned counsel for the petitioner prayed for the earlier disposal of OS.No.100/1999. Since the Civil Revision Petition is disposed of at the admission stage as the prayer sought for by the petitioner is limited in nature, notice to the respondents is hereby dispensed with.
Considering the argument advanced by the learned counsel for the petitioner and also perusal of the typed set of papers, this Court is of the view that, since the suit is of the year 1999 and since the petition under section 9 of the City Tenants Protection Act has already been disposed of and proof affidavit has also been filed, it is fit case to direct the Trial Court to dispose of the suit as expeditiously as possible.
Accordingly, the learned District Munsiff, Tiruvottiyur, is hereby directed to dispose of the suit in OS.No.100/1999 within a period of three months from the date of receipt of a copy of this order, on day-to-day basis, after giving fair opportunity to both sides.
The Civil Revision Petition is disposed of with the above direction. No costs.
