O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus to direct the first respondent to consider and pass orders on the representation of the petitioner dated 04.11.2022 for promotion to the post of Assistant by recruitment by transfer from Class VI of the Tamil Nadu Basic Service and within a stipulated period of time in accordance with law and merits.

2.The learned counsel appearing for the petitioner submitted that the petitioner was appointed as part time Sweeper at Government Branch Library, Ithalar, The Nilgiris District on 01.03.1994 and was granted special time scale of pay with effect from 01.10.2010 and he made representation to the first respondent seeking to promote him as Office Assistant, however, there is no response. Hence, this Court may issue direction to the first respondent to consider the representation of the petitioner dated 04.11.2022 seeking promotion to the post of Assistant and to pass appropriate orders. 2/4

3.The learned Special Government Pleader submitted that the petitioner is not a permanent employee of the Local Library Authority, he is only a temporary employee.

4.When a person is not a permanent staff, he is not entitled for promotion. Hence, this Court is not inclined to grant the relief sought for in this writ petition. The writ petition is dismissed. No costs.
