( Civil Appellate Jurisdiction ) Wednesday, the Twenty Fifth day of August Two Thousand Twenty One PRESENT THE HON`BLE MR JUSTICE S.VAIDYANATHAN CMP.No.10025 of 2021 and CMA.NO.353 of 2021 THE MANAGING DIRECTOR [ PETITIONER ] TAMILNADU STATE TRANSPORT CORPORATION SALEM (II) DIVISION, BHARATHIPURAM, DHARMAPURI Vs POOVARASAN [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant extension of time with the condition imposed in C.M.P.No.2393 of 2021 in C.M.A.No.353 of 2021 on 18.02.2021 (CMP.NO.10025/2021 IN CMA.NO.353/2021) Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.RAJATHI, for M/S.D.RAGHU, Advocate for the petitioner the court made the following order:- This Civil Miscellaneous Petition has been filed, seeking to grant extension of time with the condition imposed in CMP.No.2393 of 2021 in Civil Miscellaneous Appeal No.353 of 2021 on 18.02.2021.
2. On 18.02.2021, this Court passed the following interim order:
" There shall be an order of interim stay on condition that the petitioner/appellant deposits 50% of the award amount with accrued interests and costs, to the credit of M.C.O.P.No.747 of 2018, on the file of Motor Accident Claims Tribunal, Special District Court, Dharmapuri within a period of eight weeks from the date of receipt of a copy of this order, failing which, interim stay granted shall stand automatically vacated, without any reference to this Court".
3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, one month time is granted from today to deposit the amount. In case if the amount is not deposited within the stipulated time the award can be executed. https://hcservices.ecourts.gov.in/hcservices/
4. If batta is not filed within three working days excluding today, the interim order granted by this Court shall stand automatically vacated.
