Common Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to call for records in DVA.No.14/2014 on the file of the Judicial Magistrate-VII, Coimbatore and to quash the same.
For Petitioner :Mr.G.M.Ramasubramaniam senior counsel for Ram and Ram For Respondents :Mr.K.Mohanraj COMMON ORDER It is seen that Nakshathra (respondent herein) got married to Vivek on 12.05.2013 and their marriage ran into rough weather following which they got estranged. Nakshathra launched proceedings in DVA.No.14/2014 on the file of the Judicial Magistrate-VII, Coimbatore against Vivek and other petitioners. Challenging which these quash petitions have been filed.
2. It is seen that the parties have arrived at an amicable settlement and on account of which they are seeking to quash the domestic violence proceedings. Nakshathra (respondent herein) is present and a joint affidavit signed by K.Vivek and Nakshathra has been filed wherein in 3(iii) it is stated as follows: https://hcservices.ecourts.gov.in/hcservices/
" I, N.Nakshathra, hereby give no objection for quashing all further proceedings for quashing the Domestic Violence case filed by me in D.V.A.No.14/2014 pending on the file of the Learned Judicial Magistrate No.VII, Coimbatore as against the petitioner herein and also against all the respondents therein, who have preferred quash petitions in Crl.O.P.Nos.16454/2014 and 17733/2014 respectively and the same are pending before this Hon'ble Court. Both of us further agree and undertake that either of us shall disturb the other for any reason at any point of time in the future. I, K.Vivek, hereby agree and undertake not to claim any right over the child at any point of time in future."
3. In view of the above, all these petitions are allowed and the proceedings in DVA.No.14/2014 on the file of the Judicial MagistrateVII, Coimbatore is hereby, quashed. Consequently, connected miscellaneous petitions are closed.
