This Civil Revision Petition has been filed to direct the District Court, Coimbatore to dispose of the suit O.S.No.576 of 2008 on merits within a time period to be fixed by this Court.
2.Learned counsel for the petitioner submitted that the petitioner as a plaintiff filed a suit for declaration that the Option Contract bearing No.116443 to 116446 dated 27.07.2007 is void ab-initio, illegal, in violation of RBI Guidelines opposed to public policy, is a fraud on the plaintiff and unenforceable and not binding on the Plaintiff Company and also other various reliefs. The defendant/respondent filed the written statement and contested the suit. During the pendency of the suit, the defendant filed an application in I.A.No.1100 of 2008. After hearing both sides, the Trial Court has dismissed the said application which was confirmed by the Hon'ble Apex Court on 08.09.2015. Since the suit is pending for the past seven years, the petitioner/plaintiff has filed this Civil Revision Petition seeking for early disposal of the suit in O.S.No.576 of 2008.
3.Considering the limited nature of the relief as sought for herein, notice to the respondent is dispensed with.
4. Considering the arguments advanced by the learned counsel for the petitioner and on perusal of the typed set of papers, I am of the view that it is a fit case for giving direction for early disposal. Accordingly, the I Additional District Judge, Coimbatore is directed to dispose of the suit in O.S.No.576 of
2008 within three months from the date of receipt of a copy of this order. 5.With the above direction, this Civil Revision Petition is disposed of. No costs.
