PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, to declare the History Sheet No.489 of 2004 which was opened by the 2nd respondent as illegal and violating the fundamental right of the petitioner.

O R D E R

The Writ Petition has been filed to declare the History Sheet No.489 of 2004 which was opened by the 2nd respondent as illegal and violating the fundamental right of the petitioner.

2. When the matter is taken up for hearing, the learned Government Advocate ( Crl. Side) submitted that, representation made by the petitioner dated 16.09.2021 is available with the respondents and appropriate orders will be passed.

3. In view of the submission made by the learned Government (Crl. Side), this Court directs the respondent to consider the petitioner's representation dated 16.09.2021 and pass appropriate orders within a period of three weeks from the date of receipt of copy of the order.
