ORDER

This Writ Petition has been filed to direct the respondents to demarcate the pathway based on the petitioner's representation, dated 07.02.2026, within the time frame to be fixed by this Court.

2. The pathway belongs to the 1st respondent. Based on the petitioner's representation, dated 07.02.2026, the 1st respondent has already forwarded the said representation to the 2nd respondent for taking action in respect of the said representation by conducting a joint survey of the property. Till date, no joint survey has been conducted by the 2nd respondent with the assistance of the 3rd respondent. In such circumstances, this writ petition has been filed.

3. Ms.A.Rexy Josephine Mary, learned counsel, accepts notice on behalf of the 1st respondent and Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents 2 and 3.

4. No prejudice would be caused to the respondents, if a direction is issued to the 2nd respondent to conduct joint survey of the subject pathway, after giving due notice to the petitioner as well as the 1st respondent and thereafter, take a decision on the petitioner's request for demarcating the pathway Page No.2 of 4

morefully disclosed in the affidavit filed in support of this writ petition, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.

For the foregoing reasons, this Writ Petition is disposed of by directing the 2nd respondent to conduct joint survey with the assistance of the 3rd respondent in the presence of the petitioner as well as the authorized representative of the 1st respondent and if required, seek police assistance from the proper police station and thereafter, demarcate the said pathway on merits and in accordance with law based on the petitioner's representation, dated 07.02.2026. The aforesaid exercise shall be completed by the 2nd respondent, within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs.
