Defendant PRAYER: Plaint under Order XXIV of O.S.Rules read with Order VII Rule 1 of C.P.C as against the defendant praying to (a) for partition and declaration that the plaintiff is entitled to half share in plaint schedule property item 1 and 2 and for possession of her half share in item 1 and 2 of the schedule, (b) for directing the defendant to render true and proper accounts of the rents and expenses from item 1 of the schedule mentioned property ; (c) directing the defendant to pay mean profits after determining her half share in the rental income from item No.1 of the schedule mentioned property till the share is delivered to her and (d) to award the cost of the suit . JUDGMENT

This suit has been filed for partition and declaration that the plaintiff is entitled to half share in plaint schedule property and for possession of her half share in item 1 and 2 of the schedule.

2. Pending suit, the parties have settled the dispute among themselves and have entered into compromise. Today, they have filed a joint memo of compromise signed by the plaintiff, defendant and their respective counsels. The terms of the said joint compromise memo are recorded.

3. In view of the joint memo of compromise dated 20.06.2018 entered into between the parties, this suit is decreed in terms of the joint Memo of Compromise. The said joint compromise memo shall form part of the decree. Registry is directed to refund the Court fee as permissible under law, to the plaintiff. 21.06.2018 Index : yes/no speaking order/non-speaking order
