Respondents Prayer: Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents 4 to 6 to consider and dispose the petitioner's representation dated 25.03.2023 under Section 26(2) of the Tamil Nadu Highways Act, 2001 within a time limit to be fixed by this Hon'ble Court and further direct the respondents not to take any coercive action till such time. ORDER
(Made by the Hon'ble Acting Chief Justice) This writ petition has been filed for issuance of a Writ of Mandamus directing the respondents 4 to 6 to consider and dispose of the petitioner's representation dated 25.03.2023 under Section 26(2) of Tamil Nadu Highways Act, 2001 within a time limit to be fixed by this Court.
2. Learned State Government Pleader accepts notice on behalf of the respondents.
3. Since the petitioner has come with a limited prayer, without going into the merits of the matter, we direct the first respondent / District Collector, Thiruvarur District and the fourth respondent / The Divisional Engineer (Highways), Thiruvarur to consider the petitioner's representation dated 25.03.2023 on merits and pass orders within a period of four weeks from the date of receipt of a copy of this order. No costs. It is made clear that since the petitioner has built a pucca house using the funds granted under Prime Minister's Housing Scheme, status quo as on today shall be maintained by the parties.
