ORDER

[Order of the Court was made by M. JAICHANDREN, J] This Criminal Original Petition has been filed, by one Dr.M.Raghuramiah, stating that he had approached the Vice Chancellor of S.R.M.Medical College, namely, Mr.Pachamuthu, to get admission for his son, namely, Indhrakumar Varma, in the Post Graduate Course, in M.S.(Ortho).

2. Thereafter, he had been directed to approach one Madhan, who is said to be the Chairperson of Vendhar Movies and who is associated with the S.R.M. Group of Institutions, for a number of years.

3. The petitioner had been instructed by Madhan, to pay a sum of Rs.1.40 Crores, for getting admission in the Post Graduate Course, in M.S. (Ortho) Course, in S.R.M. Medical College, for his son, namely, Dr.Indhrakumar Varma.

The petitioner had paid a sum of Rs.50 lakhs to one Sudhir, on 6.8.2015, and a sum of Rs.60.00 lakhs was paid to Guna, on 13.8.2015, and a further sum of Rs.30.00 lakhs was paid to Guna, on 23.9.2015. However, no admission had been given to the son of the petitioner in S.R.M. Medical College. Hence, the petitioner had lodged a complaint before the first respondent and the same had been received by the second respondent and he had issued a receipt, bearing No.2638/CCB/Visitors/2016, dated 15.6.2016. However, no effective steps had been taken to investigate the matter. Hence, the petitioner has preferred the above Criminal Original Petition, before this Court, praying for a direction to the respondents to register a first information report, based on the complaint made by the petitioner, on 15.6.2016.

At this stage of the hearing of the Habeas Corpus Petition, the learned Additional Public Prosecutor appearing on behalf of the respondents had submitted that, based on the complaint given by the petitioner, a case in Cr.No.143 of 2016, had been registered, for the offences under Sections 406 and 420 read with 34 of the Indian Penal Code against Madhan and others.

6. In such circumstances, we are of the view that no further orders are necessary in this Criminal Original Petition. Hence, it is dismissed, as infrutuous.
