ORDER
(1)This application is filed by learned AG&OT to demolish the existing dilapidated structures in ten properties belong to various Trust estates under the control of learned AG&OT which is described in the petition. (2)A report is filed by learned AG&OT. After inspection of all the properties, learned AG&OT found that several buildings belong to various Trust estates,
viz., [1]Nurses Assocation ; [2] Bavanandam Academy ; [3] Nagai Vishalakshi Ammal ; [4]Kurumila Rangammal ; [5] Maligai merchant Charities ; and [6] Sivakamu Ammal Trust, are not in use as the buildings are in dilapidated condition.
(3)Even though the Corporation officials have visited and recommended for demolition, it is now reported that no action has been taken, probably for the reason that buildings are under the control of AG&OT. Few complaint letters have also been received by learned AG&OT for demolition of a few properties.
(4)In respect of each and every property, the Engineer attached to the office of AG&OT has given a report stating that the buildings are very old and in a dilapidated condition.
(5)It is also found that some of the buildings are likely to collapse any time and some of the buildings have collapsed already. Most of the buildings are more than 100 years old. It is also found that none of the buildings are in good condition. In such circumstances, this Court is fully convinced that the dilapidated buildings mentioned in this application, have to be demolished and removed so that the land can be put to use for generating income. (6)Learned AG&OT has also identified a contractor by name M/s.Al-Hassan Traders having office at No.88/103, Perambur High Road, Jamalia, Chennai 600 012, who is doing demolition works in the city. It is also reported that the contractor, after visiting all the sites, has offered that he would demolish the buildings free of cost provided the old wooden, iron materials retrieved
from the dilapidated structures are permitted to be taken by him. All the wooden and other retrievable materials have become old and it is not worth more than scrap. Anyone can imagine the conditions of very old buildings [more than 100 years old] if it is not used for decades. (7)In such circumstances, learned AG&OT is convinced that demolition and removal of debris by M/s.Al-Hassan Traders without cost will be more advantageous to the Trust estates.
(8)Accordingly, this application is ordered and the learned AG&OT is permitted to demolish the existing dilapidated structures numbering 10, mentioned in paragraph No.8 in this application by engaging the services of M/s.Al-Hassan Traders, having office at No.88/103, Perambur High Road, Jamalia, Chennai 600 012.
