A.Krishnan .. Defendant Prayer: The plaint is filed and numbered as Civil Suit under Order IV Rule 1 of O.S. Rules with Order VII Rule 1 of CPC, praying for a judgment and decree against the defendant a) Declaring that the action of the Defendant in interfering in any manner with the activities of the All India Overseas Bank Scheduled Caste and Scheduled Tribe Employees Welfare Association on and from 15.04.2011 on being expelled from the Primary Membership of the All India Indian Overseas Bank Scheduled Caste and Scheduled Tribe Employees Welfare Association either personally or through his men or agents as illegal and without jurisdiction.

b) grant permanent Mandatory injunction restraining the Defendant or his men or his agents or servants or anyone acting on his behalf from interfering in any manner with the activities of the Plaintiff as the General Secretary and functioning of the All India Indian Overseas Bank Scheduled Caste and Scheduled Tribe Employees welfare Association, and c) to pay the cost of the suit.

JUDGMENT

Today when the matter came up for hearing, there is no representation for the plaintiff. The plaintiff called absent. On perusal of the notes paper of the learned Additional Master III, it reveals that the plaintiff is not ready to tender his evidence, inspite of several adjournments. The conduct of the plaintiff clearly indicates that he is not interested in prosecuting the case. Hence, the suit is dismissed for nonprosecution. 24.01.2017 rm C.S.No.422 of 2011
