O R D E R

This Criminal Original Petition has been filed to transfer the case in Crime No.169 of 2022 to an other investigation agency.

2. Heard Mr.M.Gurusamy Pandiyan, learned counsel for the petitioner and Mr.A.Gokulakrishnan, learned Additional Public Prosecutor for the respondents.

3. The grievance of the petitioner is that under the influence of the College authorities, the second respondent without enquiring anybody, obtained a statement, as if no such occurrence had taken place on the fateful day, i.e., on 25/3/2022. Hence seeks to transfer the case in Crime No.169 of https://hcservices.ecourts.gov.in/hcservices/

2022 from the file of the second respondent to any other investigation agency.

4. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor, produced the counter filed by the Inspector of Police, S 11 Tambaram Police Station, Chennai, second respondent, and submitted that the investigation is pending to receive the viscera report, post mortem report and final opinion. After receiving the same, the second respondent Police shall file a final report before the competent Court in accordance with law.

5. A bare perusal of the counter affidavit and suicide note would indicate that the deceased had not mentioned anything about the College Administration and other students. Moreover, the second respondent is waiting for the reports to complete the investigation. In such a view of the matter, this Court is not inclined to entertain the instant Criminal Original Petition.

6. Accordingly, this Criminal Original Petition is dismissed. The second respondent Police is directed to investigate thoroughly on the basis of the complaint lodged by the father of the deceased girl and expedite the investigation and file a final report before the competent Court in accordance with law. It is upto the Police to file either positive or negative report based on the materials collected during investigation.
