Aravind Sathya v. Lahari Ramakrishnan

2024-07-18Honourable Mr Justice C.V. Karthikeyan3 pages

in O.P. No. 245 of 2024 C.V.KARTHIKEYAN, J.

This application has been filed seeking interim custody on every Saturdays at 5.00 p.m. to extend till 5.00 p.m. on Sundays of the minor child, who is now aged about 9 years and who is under the custody of the mother/respondent.

2. A counter has been filed on behalf of the respondent.

3. But I must appreciate that both the learned counsels have, with much sanguinity stated that the petitioner could always visit the residence of the respondent on every Saturdays and Sundays and take that opportunity to meet and interact with the child.

4. It is stated that this particular order was actually passed in a transfer petition by a learned Single Judge of this Court.

5. The learned counsel for the petitioner stated that he would go to the residence of the respondent on every Sunday at around 10.00 a.m. and be there till around 1.00 p.m. and also interact with the child and hopefully, he will also take the opportunity to have lunch at that time. I

am confident that the respondent would not deny that pleasure to the petitioner.

6. This arrangement may continue until further orders and if on any Sunday the respondent and the child or either one of them will have to go out for any function or for any other necessity or contingency, they may inform the petitioner in advance about that particular engagement. Similarly, if the petitioner is not able to go over on any particular Sunday, he may inform the respondent, so that the respondent and the child can enjoy any other avocation at that particular time. Recording as above, this application stands closed.
