O R D E R

The learned counsel for the petitioners seeks the leave of the court to withdraw the civil revision petition with liberty to move the trial court by way of a petition for deciding the question regarding limitation

as a preliminary issue. An endorsement to that effect has been made. The endorsement is recorded. The civil revision petition is dismissed as withdrawn. Liberty sought for is granted. If such a petition is filed, the court shall decide the petition on its own merits. However, there shall be no order as to cost. Consequently, the connected miscellaneous petition is closed.
