2. A memo of calculation has been filed by the petitioner. Accordingly, the order is modified as follows: In Paragraph 2 of the order, the appellate tribunal by accepting the contention of the petitioner, directed him to pay 40 % of the dues determined for recovery under 7 A of the Act, i.e. Rs. 11,70,862/- instead of 11,27,690/-.

In Paragraph 5 of the order, The learned counsel appearing for the petitioner fairly submitted before this Court, that the petitioner has agreed to pay 20 % of the pre-deposit amount, which comes to Rs. 2,34,172/-, instead of Rs. 2,15,000/-, in which the petitioner has already remitted a sum of Rs. 93,172/- instead of Rs. 90,172/- to the respondent.

3. The Registry is directed to issue fresh order copy to the parties, after making the modification in the order.
